1. General

1.1 The promoter of this competition is The Personnel Group Ltd (the “Promoter”) (ABN 27 151 658 055).

1.2 Information on how to enter and on prizes form part of the Terms and Conditions. Entry into this competition deems acceptance of these Terms and Conditions.

1.3 To the extent of any inconsistency between these Terms and Conditions and any other reference to this competition, these Terms and Conditions prevail.

1.4  This is a non-acquisitive photography competition governed by these Terms and Conditions. All instructions relating to the competition on this website also form part of the Terms and Conditions.

1.5 The Promoter reserves the right to amend these Terms and Conditions planned. The Promoter may also cancel or suspend this competition if an event beyond the control of the Promoter corrupts or affect the administration security, fairness, integrity or proper conduct of this competition. The Promoter will disqualify any individual who has tampered with the entry process or any other aspect of this competition.

2. Who can Enter

2.1 The Competition is open to any persons aged 15-21 as of December 31 2018 residing within 50kms of the following postcodes 2640, 2650, 2680, 3672, 3676, 3690.

2.2 The Competition is open to both professional photographers and amateurs and enthusiasts.

2.3 For participants under 18 years of age a parent or guardian consent is required. The consenting guardian is then bound by these Terms and Conditions.

3. How to Enter

3.1 Entries will be accepted from 9am Monday 26 November 2018 to 5pm Friday 4 January 2019. No entries will be accepted after 5.00pm 4 January 2018.

3.2 Entrants must follow the instructions provided online at www.shiningalightonme.com.au

3.3 Entry to the Competition is free.

3.4 Entrants may enter as many images as they like into the competition.

3.5 Each entry must comply with these Terms & Conditions, including submission guidelines specified below.

3.6 Entries must be submitted separately and each entry must individually meet the Technical Specifications below:

3.6.1 Saved as a High Resolution JPEG.

3.6.2 Accompanied by a maximum 150 word summary of how the image meets the competition brief.

4. Submission Guidelines

4.1 Each entry must be an original photography taken using a Smartphone device produced entirely by the entrant. It must not contain any trade marks or copyright material owned whole or in part by a third party or violate any person’s rights of privacy.

4.2 Any retouching or post production is to be completed by the entrant using the same device as the photo was taken with.

4.3 All details provided by the entrant must be true and correct.

4.4 Images submitted with watermarks or branding on them will not be considered for judging.

4.5 The image must not contain any material or content that is infringing, threatening, false, misleading, abusive, harassing, defamatory, vulgar, obscene, scandalous, inflammatory, pornographic, profane or otherwise objectionable.

4.6 The image must not plagiarises the work of any other person.

4.7 The image must not contain any material or content that could constitute or encourage conduct which would be considered a criminal offence, give rise to civil liability or otherwise violate any law either of the Jurisdiction or any other country whose laws might apply to the entry.

4.8 You must not upload or send any content which might disturb or damage the Promoter’s website or reputation.

4.9 Entries that are found to breach these Terms and Conditions, will be considered invalid and, if awarded a prize, that prize must be returned to the Promoter. The winners may be required to sign a statutory declaration regarding the originality of the entry. Without limiting the generality of the foregoing, the Promoter reserves the right to take legal action against anyone found to have breached this term. The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation are reserved.

5. Judging

5.1 All eligible phots will be considered for judging.

5.2 The judging panel will consist of a minimum of 3 members, decided at the Promoter’s discretion.

5.3  The judges will be allocating each image a mark between one to ten for –

5.4 This will be rated in a one to twenty. This creates a maximum of 40 points per judge for each image.

5.5 The top 10 highest scoring will then be rescored by judging committee. To determine prize winners. For this second judging, judges will also consider the written submission accompanying the top 10 images.

5.6  The judges’ decision in relation to any aspect of the competition is final and binding on each person who enters. Chance plays no part in determining any winner. No correspondence will be entered into. No responsibility is accepted for late, lost or misdirected entries. Prizes are subject to availability, not transferable or exchangeable and, with the exception of cash prizes, cannot be taken as cash. Prizes will be sent to the winner’s nominated address as stated in their original entry. The Promoter and their associated agencies, and companies associated with this promotion will take no responsibility for prizes damaged or lost in transit.

6. Peoples Choice

6.1 Voting for the People’s Choice will be open to all residents of Australia.

6.2 The voting period runs from 9am Monday 14 January 2019 to 5pm Friday 15 February 2019.

6.3 Voting is limited to one vote per person per day.

7. Prizes

7.1 Proses will be awarded for both judged and People’s Choice.

7.1.1 Judged awards are considered as a whole competition with prizes for Frist, Second and Third First Prize – $500 cash (or equivalent) Second Prize – $300 cash (or equivalent) Third Prize – $200 cash (or equivalent)

7.1.2 People’s Choice awards will be awarded based on the geographic location of the entrant. Entrants will be grouped based on their proximity to the following postcodes 2640, 2650, 2680, 3672, 3676. Prizes of $250 cash (or equivalent) will be awarded to the image with the highest votes in the of the regions.

7.2 In the event of a tie, the images in question will go back to the judges for a discussion and an anonymous re-vote.

7.3 Winners will be announce from Monday 18 February 2019 through our website, social media and at local events. There Promoter reserves the right to redeem all unclaimed prizes and proceed with how they deem fit.

7.4 All decisions from the judging pane are finite and there will no correspondence with entrants regarding the results.

7.5 Any winner subsequently found by the Promoter to have breached these Terms and Conditions must return any awarded prize within 30 days of a request to do so. The Promoter will not enter into correspondence regarding such a request.

8. Public Exhibitions

8.1 All entrants consent to their work being displayed at public exhibitions.

9. Rights

9.1 All copyright remains with the entrant.

9.2 The Promoter asserts no claims to the rights of any image entered into the competition except as expressed in these terms and conditions.

9.3 The promoter will acknowledge the entrant when images are used. Entrants consent to the use of their images.

9.4 By entering the awards, entrants grant the Promoter a perpetual, worldwide, royalty-free license to use credited images through the Promoter’s website and social media channels and to use entrants’ images and names either on-line or in print media to promote the awards at any time in the future.

9.5 It is the entrant’s responsibility to protect their work from third parties by entering (but not limited to) metadata into the image. The Promoter will not be liable for any misuse of images.

9.6 Each entrant acknowledges that the Promoter is under no obligation to use their entry.

9.7 Any use of the image in accordance with these terms and conditions will be at the discretion of the Promoter.

10. Privacy Collection Statement

10.1 By submitting an entry into this competition entrants consent to receive promotional and other marketing messages from the Promoter (including messages sent electronically for an unlimited period of time). Entrants will be able to opt-out at any time by following the instructions included in each message sent by the Promoter.

10.2 The Promoter and its related entities collect entrants’ personal information for the purpose of conducting and promoting this competition (including but not limited to determining and notifying winners). The Promoter may disclose personal information collected to an agent who is engaged for prize fulfilment. The Promoter may also disclose personal information collected to Australian regulatory authorities. The Promoter will otherwise handle your personal information in accordance with its Privacy Policy available at www.personnelgroup.com.au You may request access or to update your personal information or lodge a complaint by writing to The Privacy Officer, through the website.

11. Liability and Governing Law

11.1 Nothing in these Terms and Conditions limit, exclude or modify or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (‘Non-Excludable Guarantees’).

11.2 In respect to this competition, except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; or (d) any tax liability incurred by a winner or Entrant.

11.3 The Competition is governed by the laws of Victoria, Australia. Each entrant irrevocably agrees that the courts of Victoria shall have exclusive jurisdiction to hear and decide any suit, action or proceedings and/or to settle any disputes which may arise out of or in connection with the Competition and, for these purposes, each entrant irrevocably submits to the exclusive and binding jurisdiction of the courts of Victoria.

12. Image Specifications

Create an original photograph related to the theme of ‘What makes You Unique’ (Competition Theme) which:

12.1 Is submitted in .jpeg, or .jpg format, at least 2,000 pixels wide and no larger than 8 MB. Finalists will be requested to submit a high resolution file prior to the Exhibition(s) for print output.
12.2 The photograph must never have been published and not ever won a photographic competition; and
12.23 Complies with the photograph submission guidelines (Photo Submission Guidelines) set out at Point 4 in our Terms and Conditions.
